Foxy Brown's Request To Leave Jail Needs More Proof

Incarcerated Foxy Brown wants to get out of jail early and cites her ear as an excuse.

The rap star has asked to be released from prison to get treatment to seek treatment to fix a malfunctioning ear implant.

Brown, who was diagnosed with hearing loss in 2005, claims that her ear implant has malfunctioned and needs to travel to Los Angeles to have her cochlear implant reprogrammed and repaired. She filed a petition this week that says she faces "imminent harm to her hearing" if she didn't get treatment by January 30.

Supreme Court Justice Melissa Jackson told Brown she needs evidence to support the claim that the procedure can only be done in L.A. before granting the request.

Prosecutor Cindy Chung countered the request saying that there's no enough reason the entertainer couldn't get the implant done in New York. She adds that prisoners with medical condition aren't usually allowed to choose which doctor would treat them.

"The mere existence of a debilitating health condition does not merit a sentence reduction, even if it is a terminal illness. Basically, your honor, this is s desperate and frivolous petition," Chung says.

Brown was sentenced to a year imprisonment last September for repeatedly violating her probation for attacking two manicurists at a parlor in 2004.
