Ex-Wife's "Wall Street" Case Against Michael Douglas Thrown Out

Michael Douglas has temporarily kept his "Wall Street" earnings out of ex-wife's reach. A judge threw out the case filed by the cancer-stricken actor's ex-wife Diandra in a bid to get her hands on a portion of his earnings from the blockbuster sequel to his 1987 film.

Michael, 66, and Diandra, 52, married in 1977, but divorced in 2000. He is now married to actress Catherine Zeta-Jones.

And even though they have been divorced for ten years, Diandra filed a case in June against the actor, claiming that their divorce settlement entitled her to obtain half of his earnings accumulated when they were married, including any spin-off or sequel projects related to films that were made during that time.

She was asking for 50 percent of Michael's earnings from the recent "Wall Street: Money Never Sleeps," in which Michael reprised his Oscar-winning role of the greedy Gordon Gekko.

But Manhattan Supreme Court Judge Matthew Cooper said that a New York court does not have the jurisdiction over the case.

Michael's lawyer, Marilyn Chinitz, told E! News, "It's been dismissed out of New York. I don't know if she'll bring a lawsuit in California [which would have primary jurisdiction because of residency]. But I think it would be foolish to do so and will be dismissed on the merits."

Diandra now has the option to appeal the decision or re-launch the case in California.

Michael is currently battling stage four of throat cancer. Chinitz said that he is "doing terrific" after completing a treatment.
