Jennifer Lopez And Marc Anthony Divorce Rumors Persist Although Couple Deny A Split

December 30, 2008

Speculation about an impending divorce between J.Lo and Marc Anthony continues to grow even as PR reps for the two deny that a breakup is pending. Rumors began when Lopez arrived at the premiere of "The Curious Case of Benjamin Button" wearing neither her wedding ring nor her engagement ring. In similar reports, Anthony is said to have been seen partying without his wedding band on at nightspots in New York and Las Vegas.

Celebrity News Service spoke with celebrity divorce attorney, Howard London, whose firm Beermann Swerdlove has handled high profile divorces, about the legal issues that may arise if there is a divorce between J.Lo and Marc Anthony. While London is not the attorney for either Lopez or Anthony, his firm has handled high profile divorce cases including Bill Murray, Michael Jordan and rap artist, R. Kelly.

Says London, "If there is a prenuptial agreement, the prenuptial agreement will control." Further, London states, "Depending on where the case is handled, will determine how assets are divided. Some states are community property states which means that any assets or property acquired during the marriage is divided among the parties." I asked London about the issue of spousal support and he stated that when there are two parties who are self-sufficient, there is usually no support awarded.

When asked about custody of the couple's 10-month-old twins, London said, "In these kinds of cases where both parties have these kids of careers, we generally see a joint-custody situation and because of the age of the children, they can take the children on the road with them."

If there is, in fact, an impending divorce to be announced onstage on Valentine's Day as has been reported, London states that this type of announcement allows them to control the message and would imply that this would be an amicable split between the two parties.

London states that if there is an impending case, it looks like it may follow the Madonna pattern. "I admire the way in which Madonna and Guy Ritchie handled their divorce", says London. London added that it is best for all parties, especially the children, if the parties can work out their issues and file quietly as did his client, Michael Jordan. "This really is the best way to handle these type of divorces and it looks like that is the way J.Lo and Marc Anthony intend to handle their divorce if there is in fact, a case."
