Kiefer Sutherland To Be Charged With Misdemeanor Assault Over Headbutting Incident

Kiefer Sutherland is set to be charged with misdemeanor assault following his alleged attack on a fashion designer. The "24" star will reportedly hand himself into prosecutors Thursday to face the charge, with sees him accused of headbutting Proenza Schouler designer Jack McCollough at New York nightspot SubMercer on Monday.

It has been claimed the 42-year-old actor - who is currently serving a three-year probation after pleading no contest to driving under the influence (DUI) in Los Angeles in 2007, for which he was jailed for 48 days - will be given a desk appearance ticket, which will ensure he isn't jailed and is able to travel before his arraignment.

A police source told the New York daily News newspaper: "When the lawyer realized paparazzi could be sitting on his Sutherland's doorstep for two to three weeks, suddenly he wanted to come in right away and make it all go away."

It has been claimed Kiefer got into an argument with Jack after he witnessed the designer knock over actress Brooke Shields.

Kiefer allegedly asked Jack to apologize, prompting Jack to push him. Kiefer is then said to have headbutted Jack, breaking his nose.

Brooke's spokesperson has since insisted she was not involved in the incident.

However, a friend of Kiefer said: "Kiefer is sorry it happened - absolutely. It's terribly regrettable. Kiefer was provoked."

The Los Angeles District Attorney's office is expected to get in touch with officers in New York to determine whether Kiefer's probation should be withdrawn.

A spokesman for the district attorney confirmed: "We would have to decide whether or not file a probation violation and then he could potentially face the remainder of the time left on the count to which he entered his original plea."

"He could go back to jail, but that would be the maximum and a lot of it is case-specific."

Meanwhile, a representative for designer Jack has denied he was involved in any kind of altercation.

The spokesperson said: "Anyone who knows Jack McCollough knows that he would not hurt a fly. All we can say at this point is that he was the victim of a vicious, violent, unprovoked assault and that the matter is in the hands of the authorities."
